Kristin focuses her practice on labor and employment and complex commercial litigation. She works alongside general counsel and HR teams to advise them on evolving employment, labor, workforce management, discrimination, and benefits laws and regulations.

She counsels clients on how to implement best practices concerning diversity and inclusion, anti-harassment, leaves of absence, workplace accommodations, hiring, onboarding, terminations, and employee mobility. Her clients span the industries of medical, life sciences, pharmaceutical, technology, retail, and financial services.

Kristin previously worked at a top 50 AmLaw firm where she represented clients on matters of antitrust, labor and employment, and commercial litigation. During law school, Kristin interned in the legal departments of large health care systems where she worked on labor and employment matters and participated in drafting and negotiating various healthcare transactions and agreements. She also served as President of the Health Law Association and was invited to participate in the prestigious Honorable Barbara M. G. Lynn Inn of Court.

LABOR AND EMPLOYMENT

Counsels businesses on how to maintain compliance with evolving employment, labor, workforce management, discrimination, and benefits rules and laws.

Advises legal departments on adhering to state and federal labor and employment laws, including FLSA, FMLA, Title VII, ADA, OSHA, ERISA, and the ACA.

Represents employers in arbitration forums, as well as state and federal courts, on matters involving wrongful termination, harassment, discrimination, retaliation, denial of accommodations/leaves, and wage and hour violations.

Understanding and enforcement of employment-related policies, procedures, and agreements ranging from executive compensation, commissions, consulting and vendor services, terminations, arbitration, and proprietary information and trade secret protection.

ERISA COMPLIANCE COUNSELING AND LITIGATION

Prepared and enforced employment agreements, mandatory arbitration agreements, and injury benefit plans for Texas-based companies spanning the entertainment, sports, and sanitation industries.

Represented Texas nonsubscriber employers in defense of wrongful death and workplace injury claims.

ANTITRUST LITIGATION

Served as part of Winston’s trial team defending chicken producers in an antitrust class action against claims of conspiracy to reduce market supply and allegations that the conspiracy cost plaintiffs over $22 billion in damages.

Served as part of a national team of counsel representing plaintiff-providers against Fortune 50 insurer in complex MDL class action involving antitrust violations and billions of dollars in damages.

Defended a Fortune 500 healthcare provider against claims of anticompetitive practices (Sherman Act and Clayton Act violations).

HEALTHCARE PROVIDER COUNSELING AND REPRESENTATION

Represented healthcare providers in professional liability matters, government investigations, and licensing board investigations.

Advised healthcare entities and acquisition groups on employment best practices.
