Condon Tobin successfully represented its client in a high-stakes breach of lease case, securing a complete reversal of an $8.5 million trial court judgment on appeal.
The firm’s appellate victory not only vacated the substantial judgment against the client but also reinstated the client’s counterclaim for unjust enrichment.
The case, initially decided at the trial court level, resulted in an adverse ruling against the client, dismissing their counterclaim and awarding the opposing party $8.5 million. On appeal, Aaron Z. Tobin, Jared T.S. Pace, Nick H. Burns, and Bill Whitehill argued successfully that the judgment was improper. The court of appeals agreed, reversing the decision and reviving the counterclaim, paving the way for the client to pursue their claims.
“This outcome is a testament to our firm’s dogged pursuit of justice, strategic litigation approach, and appellate advocacy, ensuring that our client’s position was fully and fairly considered,” said Aaron Tobin.
Condon Tobin remains committed to delivering exceptional legal representation in complex commercial litigation matters, from trial through appeal.
